Introduction

Welcome to Bondify! Our goal is to simplify and automate complex debt processes. This document contains the privacy policy of Bondify B.V., a private limited liability company incorporated under the laws of the Netherlands, with its registered office at Stationsplein 45, 3013AK Rotterdam, the Netherlands. Bondify B.V. is registered at the Chamber of Commerce (Trade Register) under number 74163671.

Scope

This Privacy Policy applies whenever you interact with Bondify through browsing the Website, contacting Bondify via Contact Form or in any other way or registering on and/or using the Bondify Platform, via the web browser or the mobile app. This Privacy Policy lays out how Bondify collects, processes and stores Personal Data, when browsing the Website, contacting Bondify and /or registering on and/or using the Platform.

Client

The legal entity that has entered into a User Agreement and is represented by a User or a Transaction Team.

The forms on the Website, which can be used to get notified or inquire about the Platform.

REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27 April 2016 on the protection of natural persons with regard to the processing of Personal Data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).

Personal Data

Information provided in any form, used, stored or processed on the Platform. Personal Data may include any information relating to an identified or identifiable natural person, including but not limited to full name, phone number, e-mail address, passport and ID number, profile picture.

Platform

The secure online User-environment of Bondify, including tools for initiating, drafting, negotiating and concluding Transactions, and all supportive and facilitating functions, accessible via my.bondify.com or the mobile app.

Privacy Policy

This Privacy Policy, as amended from time to time.

Transaction

Any debt process, that includes long and short-term debt instruments such as: (syndicated) loans, bonds, medium term note programmes, commercial paper, commenced or continued on the Platform, in progress, either completed or not completed.

Transaction Team

Every User engaging on the same Transaction.

User

A natural person, registered on the Platform, legally authorized to act on behalf of the Client.

Visitor

Anyone browsing the Website.

Bondify is committed to protect your privacy and Personal Data by following this Privacy Policy, in accordance with the GDPR. As stated in the GDPR, there are multiple legitimate instances for collecting Personal Data, of which Bondify relies on the following: i) your consent, ii) stipulated in a law or iii) in our legitimate interest. “Your consent” covers everything you fill in on the Website or on the Platform. “Stipulated in a law” means European or Dutch laws which oblige Bondify to collect certain data or save certain data for a longer term. “Our legitimate interest” covers the operation of the Website and the Platform in the broadest sense.

Bondify uses Personal Data only for the purposes mentioned in this Privacy Policy. If there are amendments to this Privacy Policy, Bondify will give notice and ask for consent if needed. Bondify will comply with any legitimate request for information from any governmental or supervisory authority in the exercise of their duties. Before Bondify shares any data with any authority, Bondify carefully checks any legitimate interest.

By submitting information about a person, you represent and warrant that you are authorized to do so and confirm that you have received the other person’s consent to use, disclose and transfer this person’s Personal Data in accordance with this Privacy Policy. If not authorized, you should not provide any data about anyone but yourself.

Bondify uses Google Analytics for analytical cookies, which is made privacy-friendly by way of:

- signing a processor agreement with Google

- hashing the last numbers of the IP-address and encrypting the data

- not sharing of any personal data with Google and

- not sharing of any personal data with Google advertisements and

- blocking cross-device recognition by Google

How and when does Bondify collect Personal Data?

Bondify collects Personal Data when contacting Bondify by Contact Form, e-mail, phone, post or otherwise and upon registration on the Platform or using the Platform.

If contacting Bondify by e-mail, phone, post or otherwise, you provide Personal Data yourself by making it accessible. If contacting Bondify by Contact Form or registering on the Platform, Bondify collects Personal Data upon you filling in the requested fields. If using the Platform, Bondify collects Personal Data from the use of it.

What type of Personal Data does Bondify collect?

The type of Personal Data Bondify collects depends on the interaction you have with Bondify.

Contacting Bondify

Reaching out to Bondify via e-mail means that you have provided your e-mail address, and any other information that you make accessible via your e-mail.

Reaching out to Bondify via phone means that you have provided your phone-number, and any other information that you make accessible via the phone.

Reaching out to Bondify via post or otherwise means that you have provided any information that you make accessible via post or otherwise.

Contact Forms

When using the Contact Form for notifications relating to the launch, you provide Bondify with your e-mail address. After launch, these details will be removed.

When using the Contact Form for inquiries about the Platform, you provide Bondify with your full name, e-mail address, phone number and personal message. After the corresponding, these details will be removed, unless from the correspondence follows these details can be stored longer.

Website

Bondify only uses necessary cookies and anonymized analytical cookies on the Website. Bondify collects no Personal Data from Visitors.

Platform

The Personal Data collected from Users upon registration includes full name, e-mail address, phone number, business contact details, function and other required information.

Additionally, Bondify collects Personal Data to track User behavior on the Platform for analytical and statistical purposes. This helps optimizing the Platform and improving the overall User experience.

User behavior data includes both quantitative and qualitative data. For example, number of visits, clicks, taps, scrolling, location data, surveys, user feedback and session-related data.

How does Bondify use Personal Data?

Bondify uses Personal Data collected from Contact Form, e-mail, phone, post or otherwise only for the corresponding itself.

Bondify uses Personal Data in the Platform to enable and facilitate the Client’s due diligence, compliance and credit risk assessment processes.

Bondify also uses Personal Data to verify User identity, prevent fraud and create a secure Platform.

Furthermore, Bondify uses Personal Data to communicate with the User about Bondify, to process and respond to enquiries or complaints, and/or to improve the Platform.

Moreover, Bondify uses Personal Data for legitimate business purposes and in accordance with data protection legislation.

In addition, Bondify uses tokens for the purpose of keeping track of logged-in Users. Tokens are connected to the identity of the individual Users and prevent others from interfering with their session.

How does Bondify store and protect Personal Data?

All Personal Data Bondify collects is stored securely on our servers/cloud within the European Economic Area. Bondify implements various other technical and administrative safeguards to protect Personal Data, such as encrypting the Personal Data and limiting access to certain employees only.

Bondify strives to maintain a secure Website and Platform and protect Personal Data from any unauthorized access and against other risks.

What are your rights regarding your Personal Data?

You may always ask Bondify to inform you, correct, access, rectify, delete, or restrict processing of your Personal Data. Bondify will ask you to upload a copy of a valid identity card or passport to verify your identity when requesting access to your Personal Data.

Note that for legal and regulatory purposes, Bondify may keep some Personal Data, only as strictly necessary to comply with possible legal processes (subpoenas, court orders, other enforceable governmental request). Bondify shall only do this in compliance with the public interest and if required by law.

When does Bondify share Personal Data?

Bondify shares Personal Data with governmental and supervisory authorities when requested, but only if permitted by law. Some Personal Data is shared with other Users on the Platform as far as it is relevant to the use of the Platform. Bondify shares no Personal Data with any third parties, nor sells Personal Data to any third parties.

How long does Bondify keep Personal Data?

Bondify will only retain Personal Data for as long as necessary, related to the purpose for which the Personal Data was collected and to the extent permitted or required by applicable law, and will then proceed to remove it from its system and records.

Users can request Bondify to longer contact them or deactivate their account completely.
