Bondify B.V. Acceptable Use Policy

Article 1 – Definitions
Acceptable Use Policy or Policy:
This policy, regulating the required conduct of all Users and Visitors.
Bondify:
Bondify B.V.
Client:
The legal entity that has accepted an Offer for the SaaS Services.
Offer:
Written offer issued (offline or online) by an authorized representative of Bondify for the provision of SaaS Services to the Client.
Platform:
The secure online User-environment of Bondify, including tools for initiating, drafting, negotiating and concluding Transactions, and all supportive and facilitating functions, accessible via my.bondify.com or the mobile app.
SaaS Services:
Making a standard Bondify software application, managed and hosted by Bondify as identified in the Order, available for use by the Client over the internet on a ‘Software as a Service’ (SaaS) basis.
Transaction:
Any legal agreement commenced or continued on the Platform, in progress, either completed or not completed.
User:
A natural person, registered on the Platform, legally authorized to act on behalf of the Client.
User Agreement:
The agreement entered into between the User and Bondify, relating to the rights and responsibilities of the User.
Visitor:
Anyone browsing the Website.
Website:
The publicly accessible Bondify website https://www.bondify.com and underlying webpages.
You:
The Visitor or User.
Article 2 – Introduction
This Policy sets forth the guidelines for the acceptable use of Bondify’s Website and Platform. Bondify strives to build trustworthy Platform that helps you on automation of Transaction processes. To do so, Bondify needs to keep its environment safe. This means that if you use the Platform, you agree to be bound by this Policy as well as by the User Agreement (if applicable) which is hereby incorporated by reference and is made accessible to you via your User profile.
Article 3 – Website and Platform
3.1 Website
The Website contains information about Bondify and the SaaS Services. As a Visitor, you can browse the Website freely and access the content of the Website for information. The use of the Website is at your discretion and risk.
3.2 Platform
As a User, you can access the Platform through a User account. The Platform offers SaaS Services that are offered on a B2B-basis that provides a set of tools to facilitate Transactions. The Platform is not intended for personal use. The use of the Platform is at your discretion and risk.
Article 4 – No Unlawful or Prohibited Use
4.1 You shall refrain from browsing or using the Website or Platform for any purpose that is unlawful or prohibited by this Policy or any laws. You shall refrain from browsing or using the Website or Platform in any manner that could impair, damage, disable or overburden them.
4.2 You shall not obtain or attempt to obtain any material or information through any means not intentionally made available or provided to you. Copying or monitoring any information found on the Website or Platform by using any bot or other automatic devices or for any unauthorized purposes shall not be allowed. You shall refrain from creating frames around any part of the Website or Platform or using other techniques that copy, monitor, or alter the visual presentation or appearance of the Website or Platform in any way. Hacking, altering, or any type of reengineering of the software is strictly prohibited. You shall refrain from engaging in attempts to reverse-engineer and/or decompile Platform. You shall refrain from hacking (or attempts thereof) data, information, software, or hardware that belongs to Bondify, other Users or third parties.
4.3 Bondify will fully cooperate with police and governmental authorities in case of investigations of illegal, criminal, or harmful activities.
Article 5 – Termination/Access Restriction
Bondify reserves the right, in its sole discretion to:
- terminate access to all or any part of the Website at any time if you do not comply with this Policy; and
- terminate or disable your User account and access to Platform at any time if you do not comply with this Policy or the User Agreement.
